Jenny’s story

I applied for a job which had an age restriction of 21 years old and I was only 20 years old, I managed to get an interview and was given the job even though it had restrictions based on the assumption that a the employee needed to be 21 years old in order to drive minibuses on behalf of the employer. After working for about 6 months a problem arose because I was unable to drive the minibus on behalf of the employer and this resulted with me being dismissed from the job.

I contacted Northamptonshire Rights and Equality Council (NREC) who lodged a Claim for unfair dismissal and age discrimination on my behalf and sent an Equality Act 2010 Questionnaire on my behalf. In the replies to the Equality Act 2010 Questionnaire it was made clear that the employers had been wrong in their belief that I was not allowed to drive minibuses on their behalf because I was below the age of 21. In fact I should have been allowed to drive several of their minibuses as the age restriction of 21 was not as they had believed it to be, because I had a full driving license. The employer removed the age restriction and I was paid compensation to prevent the matter going to a full Employment Tribunal.  I would not have found out that my employer was wrong in their belief about the age restriction had I not received the assistance from Northamptonshire Rights and Equality Council.
