IS IT DISCRIMINATION?
If you feel there are policy or other changes in your workplace or in public services that have been made on the basis of eg: your age, disability, gender, nationality, pregnancy, race, religion, sexuality, or sexual orientation; or if a policy, though applied equally, puts you and/or others in a particular group at a disadvantage – you may be experiencing discrimination. For example: it is not lawful to be selected for redundancy on the basis of age or on the basis that you have taken maternity or paternity leave in the past.
ARE YOU IN TIME?
For employment tribunals:
You must lodge a complaint of discrimination in an employment tribunal within 3 months minus 1 day of the act of discrimination. A written grievance must also be prepared in advance of an employment tribunal application.
A tribunal claim for redundancy pay must be made within 3 months minus 1 day. But first, the Advisory, Conciliation and Arbitration Service (ACAS) must be contacted about ‘early conciliation’ as an alternative to a tribunal hearing. However, if after this you still wish to go to tribunal, ACAS will provide an early conciliation certificate number – needed for the Employment Tribunal ET1 Claim Form.
For goods and services
A complaint about discrimination in goods and services must be made within 6 months
Our Discrimination Advice is given in accordance with the Advice Quality Standard (AQS) .
The AQS is awarded to organisations that give advice to members of the public on legal issues. Organisations are audited every two years and have to demonstrate that they are accessible, effectively managed, and employ staff with the skills and knowledge to meet the needs of their clients.
